CONSUMER TERMS & CONDITIONS

These Terms and Conditions supersede all prior terms applied with the User. For any questions, remarks or technical issues with respect to this Site, please contact us. These terms and conditions were last updated on 1st August 2021.
We reserve the right to make changes to our terms & conditions at any stage without prior notice.
These Conditions explain the rights, obligations and responsibilities of both The Handbag Spa and you, the Customer, in relation to the Services to be provided by The Handbag Spa. The Handbag Spa undertakes to exercise the utmost care in processing articles entrusted to us and use such processes which, in our opinion, are best suited to the nature and condition of each individual article. However, The Handbag Spa cannot assume responsibility for inherent weakness of, or defects or stains that are not readily apparent prior to processing. This applies particularly, but not exclusively, to Suede, Nubuck and Leather.
There are a few things that we need to share with you.
The Handbag Spa is a trading name of The Leather Spa Ltd, a company registered in England and Wales, registration number 07281788.

Many of the products and services that we sell online are personalised for you using the information that you provide, therefore, the information requested when you order must be filled in accurately by yourself and we cannot be held responsible for any mistakes you make when ordering your item(s).
It is not normally possible to cancel orders you have placed especially for personalised products but if you contact us quickly enough we will do our best to cancel your order. By using our website, we ask you not to upload any images that are under copyright without the copyright holder’s permission in writing and do not attempt to upload any obscene or objectionable images or text. We may have to cancel your order and refund your payment if such images or text are sent to us. We also ask you too backup any images that you send to us.
Any dispute regarding the validity, the interpretation and/or the execution of the Terms and Conditions is solely governed by the laws of England and the English courts. This clause does not affect your statutory rights.
None of the above terms and conditions affects your statutory consumer rights.
The Handbag Spa delivers a market leading cleaning & restoration services around the world for luxury brands such as; Mulberry, Chanel, Gucci, Dior, Sophie Hulme, Hermes, Balenciaga, Celine, Jimmy Choo, Louis Vuitton, Michael Kors, Miu Miu, Prada, Tods, YSL and many more.
The Handbag Spa has a highly trained team specialising in designer brands and genuine leather, we offer:
– ink removal
– stain removal in and out
– colour restoration
– corner and edging repair
– colour change
– mould removal
and many more services
We also use our exclusive Anti-Bacterial product.
Companies around the world have tried to copy us, (even using our pictures and claiming to have been around for longer periods) we take that as a compliment.
PRICES AND TAXES
All prices are subject to change and the prices on the web site will over rule any printed catalogues which are deemed to be out of date.
We have a workshop in Harrogate North Yorkshire and trained (by us) technicians around the world, we may at times out outsource work to them in the event of us being busy, or that the technician has specialised skills that are needed to finish our customer’s product, or if geographically it makes sense to minimise our costs and the price you pay.
We will cover your Item(s) in the event that they are lost, stolen or damaged beyond repair in circumstances beyond our control.
Items in our care are;
Any Item currently having our services carried out, or waiting for our services to be carried out.
Any Item in transit with our Courier.
Any item waiting for payment.
The Handbag Spa are a cleaning repair & restoration service and any Items that are sent to us are in a damaged and/or devalued state.
At the Handbag Spa we receive very few complaints however in the unlikely event that an item becomes damaged under our care the liability of the item shall not exceed 5 times the repair cost regardless of brand or condition unless previously agreed in writing between both parties.
Exclusions to Liability
Any damage which is not related to or caused by our services.
Any damage not related to the services that have been agreed
Where an item is repaired to a reasonably satisfactory standard no liability will be accepted for any depreciation in value.
Loss of value against manufacturer original models after the service has been carried-out.
Where additional insurance cover has not been taken out for goods in transit -standard cover only will apply.
We cannot be held liable for:
Any damage to, or defect in, an item which we have not been contracted to work on (this includes hardware).
Delays or failures which are due to any cause beyond our reasonable control.
Failed repairs due to inherent problems within the material or structure of the item – please note that charges may still apply for any work already completed.
Problems occurring when carrying out work on items previously repaired by another party.
Problems occurring that are deemed to be caused by the use of inappropriate care products.
The Handbag Spa use industry standard techniques and professional materials, we do not warrant use of, or employment of, manufacturer original materials or processes. Where original materials are not available, parts and colours will be matched as closely as possible to the original – or to the agreed specification (such as colour matched to a particular part of the Item).
The Handbag Spa cannot be held liable for the loss or damage of any accessories, such as dust bags, locks, credit cards etc. that are not noted on our system during the booking in procedure.
If any service recommended to you by The Handbag Spa is rejected, The Handbag Spa cannot be held responsible for the outcome of any work carried out that does not meet the customer’s expectations
The Handbag Spa will not pay compensation for anything that falls outside the work we provide.
Any loss of product orders due to incorrect information supplied or refusal to deliver by the selected shipping service for whatever reason
We cannot guarantee the removal of any stains, some linings that are heavily soiled may be difficult to clean well. Stain removal is added service and not part of a basic clean.
Should a stain be unable to be removed we will match the colour of the bag and apply a coat of colour over the stain to hide it. This process is only possible on leather and cannot be done on suede, nubuck, canvas or fabric. This service is not included within the price of cleaning.
On Suede and some other materials some types of stains may not be removable.
It is important to make clear that adhesives, defects and faults which were previously camouflaged in manufacture may become more apparent after the cleaning process, we may be unable to disguise natural flaws or totally remove adhesives, or other techniques employed by the manufacturer. All items are therefore only accepted by us for cleaning at your own risk.
Leather handbags with age can become worn and discoloured, the dirt on the bag can sometimes hide this wear & tear and our cleaning process will expose it. In the event of this happening we will notify you offer to upgrade your service to restore the colour to these areas. (It is not our cleaning process that has caused this damage and so we will not be liable for it.)
After applying some of our services to your handbag, the texture may slightly change from the original. The worse the damage is, the more of our products need to be applied and so the more the texture might change, during our processes we make every effort possible to restore an item to how it originally was.
Leather becomes dirty, it can develop a shine. After cleaning leather and removing the dirt this shine is also removed which restores the leather to how it originally was. We accept no liability for a complaint in such circumstances. The shine can be increased on leather with additional services if required.
When restoring a full item of leather, we will endeavour to match the colour to the most original part of the item, this is usually found on the inside of a pocket, the inside of the item or in any area that has not been or had little exposure to sunlight and wear & tear. We will match to such an area unless a different area is documented at the booking in stage.
When restoring the colour to only part of an item we will match the colour to the surrounding area to help it blend in better. We will always clean the full item before doing this to help equalise the colour as best as possible. However, if some leathers are also worn in other areas our process may highlight these areas further.
Suede/Nubuck – some types of stains may not be removable and stains already present may become more obvious with cleaning. Because of the nature of the material, significant improvements are not always possible. In some cases, colours can become faded with cleaning, and any embossed print can be affected.
All items are therefore only accepted by us for work at your own risk.
We guarantee our labour and materials for a period of 6 months after work has been completed providing that the item has been maintained using the recommended Handbag Spa products which will be offered to you on acceptance of your bag. If The Handbag Spa feel that at any time the item has been misused within this period, the guarantee will be null and void.
If the fault is through misuse or customer liability any work to rectify the fault will be at your own cost.
Should your package be damaged in transit you need to let us know within 24 hours.
If you are unhappy with the work that has been carried out you must contact us within 48 hours of receipt.
If we are found to be at fault we will endeavour to repair and/or alter the Item to your satisfaction at our cost. In all circumstances this will be the first course of action. Where the item has to be returned to us for this purpose, we will reimburse your costs of dispatch with evidence of a valid receipt/invoice.
Returns are made at your expense, although we may waive this responsibility in certain circumstances.

Any claim settled will be on the condition that it is accepted by the customer as full and final settlement.
The Handbag Spa accepts payments by a valid Credit Card; Debit Card; PayPal account, Bank Transfer or The Handbag Spa Gift Voucher.
Payment must be made in £GBP.
No work will commence until payment is received in full.
Once received by The Handbag Spa your bag will be assessed and the work required confirmed.
If you have already had an estimate for the work we reserve the right to suggest other services if the wrong treatments have been requested.
All work will be agreed with the customer prior to any work taking place.
You will be contacted for payment for the work prior to treatments being carried out.
Our system notes a record of emails sent and/or telephone messages left and this will be deemed evidence of contact with you.
Where an item has not been paid for within 30 days we reserve the right to charge additional fees for storage of your item.
Any item left with us for over 13 weeks may be disposed of.
The Handbag Spa reserves the right to refuse any work, wholly or partially
We do not store credit card details nor do we share financial details with any 3rd parties.
We may contact you using details you have supplied to us to ask about the service you have received from The Handbag Spa or are receiving at The Handbag Spa.
Each quotation will state the lead-time. All our lead times are estimates only.
The Handbag Spa, however cannot be held responsible for delays to the service caused by unforeseen circumstances or additional requirements.
COLLECTION & RETURN
We use DHL to collect and return your bag, the cost of the collection and return are included in the price. (UK only)
If we are unable to collect or return your bag at the time agreed with you any future collections or returns may be charged for.
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order.
ACCURACY OF CONTENT
The Handbag Spa uses its best efforts to keep the information on the Site updated. However, it is not possible to guarantee the complete absence of errors on the Site. The information and other material published on this Site may include inaccuracies or typographical errors. We have made reasonable efforts to ensure that product information is accurate and to display as accurately as possible the colours of our products. Changes are periodically made to the information on the Site without notice to you. The Handbag Spa reserves the right to change the Site at any time, at its discretion. The Handbag Spa does not warrant that the functions contained in the Site or any materials or content contained therein will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available is free of viruses or other harmful components. The Handbag Spa shall not be liable for the use of the Site, including, without limitation, the content and any errors contained therein.
Each product purchased is sold subject to its product description which sets out additional specific conditions related to that product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.
Please note, however, that all product descriptions and images are for display purposes only and do not represent the finished product.
The Handbag Spa cannot accept any liability for products that are used incorrectly or for any purpose other than their intended use and are sued at the customers own risk.
All orders are shipped within 48 working hours of receipt except in exceptional circumstances such as extended holiday periods, pandemics etc.
There is always an option at the checkout to select either a Tracked/Courier or Standard Service. Please select your option carefully.
Orders shipped by a Tracked Service are shipped via a courier service and a tracking number will be sent to you
These orders are shipped by Royal Mail/Air Mail and do not have a tracking number but we do have a Proof of Postage for all overseas orders.
Orders sent by this service will not be covered for loss or non receipt.
DELAYS IN DELIVERY
Due to Covid/Brexit/Industrial Action and other delays in delivery we have to allow up to 28 working days for overseas delivery of product orders where a Tracked Service has not been requested.
For UK deliveries all delivery timings are estimates only and The Handbag Spa cannot be held responsible for delays due to industrial action or other delivery issues which are beyond our control.
We have to allow up to 10 working days for delivery of non tracked orders
Please contact The Handbag Spa office if you do not receive your order within this time.
Where a product is returned it must be in an unused and resaleable condition for a refund. Postage costs will not be reimbursed unless a product is found to be faulty.

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your personal information.
Use Limitations and Intellectual Property Rights
All brand names, product names and titles used on the Site are trademarks or trade names of The Handbag Spa or third party trademark or trade name holders. You are not allowed to use or reproduce any such trademarks or trade names as this may constitute an infringement of the holders’ rights. All Site design, texts, documents, movies and other services and the selection and arrangement thereof, and all other material on this Site are protected by copyright of The Handbag Spa or its suppliers. You are only allowed to electronically copy and print portions of the Site to the extent this is necessary for the purpose of placing an order, or for using the Site as a shopping resource. You are not allowed to make any other use of the information and materials on the Site, including reproduction for the purposes other than those noted above, modification, distribution, or (re)publication. Use of Information
We cannot accept returns or requests for refunds on the basis of the customer’s change of heart
We cannot accept returns or requests for refunds where a change to an order had been requested and that change could not be fulfilled.
